APPLICATION OF THE GENERAL CONDITIONS OF SALE
In these General Conditions of Sale the term “OCEANICA” means OCEANICA SA and the “Client” means any person or entity purchasing a product from OCEANICA; “Contract” means any agreement to the effect that buyer shall purchase products from the website OCEANICA; “Goods“ means any product sold or licensed by OCEANICA; These conditions shall govern any sale and delivery and any offer made by OCEANICA.

DELIVERY IN SWITZERLAND
Delivery is usually made within 24 - 48 hours throughout Switzerland (except on public holidays and weekends) if the order is received by 4.00 p.m. Our parcels are always dispatched by express post in special packaging containing cooling elements, because our products are perishable. Please place the goods in a refrigerator immediately upon receipt. All shipping costs will be at your charge. We guaranty that all products are in perfect conditions leaving OCEANICA and that we are not responsible for any damages caused during the transport.

INTERNATIONAL DELIVERIES
OCEANICA can reserve the right to use a third party to deliver internationally.

FURTHER CONDITIONS OF DELIVERY
All our offers are subject to change without notice. Invoicing is made according to the actual quantity delivered where the items are priced in kilograms or grams. We can only acknowledge any possible complaints concerning the goods within 24 hours following receipt of them, in view of the fact that our products are perishable. Please keep the queried product in safe custody for an analysis to be carried out by us. We expect that goods are returned in the same condition as they were on purchase. Please do not forget to return the package to us as quickly as possible by express post. Any credit balance arising from the return will be settled by us without delay, unless you wish to use it for a further order. These general sales conditions may not be cancelled by our customers by terms stipulated on their part. The orders for delivery placed with us are in all cases subject to the law of Switzerland, and Geneva is deemed to be agreed as the place of jurisdiction.

PRICES
Our prices are including VAT. All earlier prices cease to apply on publication of this catalogue or price list. We reserve the right to make price adjustments and we shall notify you of this before processing your order, if such a case arises. OCEANICA attaches great importance to supplying only the best quality. Therefore, it may occur that we do not hold a particular item in stock at the delivery date desired by you. In this case, we shall substitute this item with another of at least the equivalent standard, without prior notice and at no extra expense for you.
Our Caviar Perle Noire selection in original tins are all hand packed individually. Therefore, the weight shown for these products are approximate, a variation of plus or minus 5% can occurs.

ALCOHOL
Please note that OCEANICA can not sell alcohol to people under 18.

RETURN AND CANCELLATION
You have a general right to return non food goods only within a period of 14 days. You are obliged to return the goods to us in the same condition as they arrived and to take reasonable care ensuring that the goods are received by us and are not damaged in transit. For fresh foods return, please see the article “Further
conditions of delivery”.

DATA PROTECTION
For processing your order, we store your address and other data relating to the order. We guaranty protection of your personal particulars, according to the provisions of the international data protection law. We assure you that we shall not pass details of your address and that of the recipient of gifts, to a third party.

CLIENT OBLIGATION
The client is personally liable for its choice of items and after delivery is entirely responsible for the conservation and consumption of the items. The client must consume the items before the expiration date. Caviar Perle Noire products and all other products appearing on the web site cannot be resold. The client represents and warrants that he is purchasing Products or Services from OCEANICA for his own account and use and not on behalf of any other person or entity.

The client assumes all risks once they have left OCEANICA. If any damage occurred to the goods during shipping, a funded protest should be addressed to the courier. Unless presented with such a document, OCEANICA declines all responsibility regarding shipping and will not be liable for any damage unless expressly accepted otherwise by OCEANICA.

PAIEMENT METHOD
You can pay by credit card issued by American Express, MasterCard or VISA.

MISCELLANEOUS
Our offer is subject to change without notice. Because our products are not mass-produced articles, slight deviations from the photographs and specifications contained in the website may occur.

APPLICABLE LAW
These General Sales Conditions are under laws of Switzerland.
